Terms and conditions
These Terms & Conditions apply to all bookings, sessions, products, digital files, prints, frames, and services provided by Iris Photography AU.
By booking a session, attending a session, purchasing a product, or engaging our services, you confirm that you have read, understood, and agreed to these Terms & Conditions.
If you are booking on behalf of a group, family, partner, child, or any other person, you confirm that you have the authority to accept these Terms & Conditions on their behalf.
1. Bookings, Arrival Times & Session Policy
Please arrive on time for your scheduled appointment. Our sessions may run back-to-back, so late arrivals may result in a shortened session or, where we are unable to fit you in, your session may need to be rescheduled.
If you arrive late, we will do our best to complete your session within the remaining time available. However, late arrival may result in a shortened session, reduced service time, or the need to reschedule.
If you do not attend your appointment without giving reasonable notice, you may be charged a cancellation or no-show fee where this was stated at the time of booking.
If you need to cancel or change your appointment, please contact us as early as possible. Where a cancellation policy, cancellation fee, or no-show policy is stated at the time of booking, that policy will apply.
We reserve the right to refuse, pause, cancel, or reschedule a session if we believe it is unsafe, unsuitable, unreasonable, or not possible to complete the session properly.
2. Pop-Ups, Markets, Events & Temporary Locations
For pop-ups, markets, events, and temporary studio locations, session times, locations, and availability may change due to weather, venue requirements, market decisions, council rules, travel delays, illness, equipment issues, supplier issues, or other circumstances outside our reasonable control.
Where this happens, we will make reasonable efforts to reschedule, relocate, or provide an alternative arrangement where possible.
We are not responsible for additional costs you may incur due to changes, delays, rescheduling, cancellations, or location changes, including travel costs, accommodation costs, parking costs, or loss of time.
3. Payment Terms
Payment is due at the time stated during booking, purchase, checkout, or at the session.
Digital files, prints, frames, acrylics, canvases, and other products may not be released, ordered, printed, delivered, or supplied until payment has been received in full.
Where we allow delayed payment, part payment, payment plans, or payment by arrangement, this is offered at our discretion and does not waive our right to request, recover, or withhold products until unpaid amounts are received.
Prices, packages, promotions, and product options may change from time to time. The price that applies to your booking or purchase is the price confirmed at the time of booking, purchase, or checkout, unless otherwise agreed in writing.
4. Photography Process & Flash Disclaimer
Our iris photography process involves the use of a small flash of light to capture fine details of the iris.
If you or anyone in your group has light sensitivity, epilepsy, a medical condition, eye condition, recent eye surgery, or any condition that may be affected by bright flashes or close-up eye photography, you must inform us before the session begins.
By proceeding with the session, you acknowledge that you are responsible for telling us about any relevant condition before the session. Iris Photography AU is not liable for discomfort, sensitivity, or adverse reactions where we were not informed of a relevant condition beforehand.
If we believe it may not be safe or suitable to proceed with a session, we may refuse, pause, stop, or reschedule the session.
5. Photo Editing, Artistic Style & Colour Variation
All iris images are artistically edited to enhance detail, clarity, colour, contrast, and overall presentation.
While we aim to keep the iris texture and colour as authentic as possible, the final artwork may appear different from how the eye looks in person due to lighting, reflections, natural eye colour variation, camera settings, editing style, screen settings, print materials, and viewing conditions.
By purchasing an iris image, digital file, print, frame, or other product, you acknowledge that the final result is an artistic interpretation of your iris and may include creative editing choices.
Minor creative decisions, including crop, colour tone, contrast, sharpness, background style, and layout, are made at our discretion unless specific requests are agreed before editing begins.
6. Custom Text, Names, Dates, Coordinates & Personalised Details
If your artwork includes names, dates, quotes, coordinates, locations, spelling, or any other personalised details, you are responsible for checking that all information provided is correct.
Once a design has been approved, printed, exported, ordered, or delivered, we are not responsible for errors in customer-supplied information.
Any corrections, re-edits, reprints, replacements, or changes requested after approval, export, print, order, or delivery may incur additional costs.
7. Not for Medical, Biometric, or Identification Use
Our iris photography is created solely for artistic and decorative purposes.
Our images are not medical images and must not be used for diagnosis, treatment, eye health assessment, biometric identification, authentication, verification, tracking, classification, or any other technical identification purpose.
We do not create biometric templates, use biometric recognition systems, or link iris images to facial recognition, authentication, verification, or identification systems.
If you have any concerns about your eye health, you should seek advice from a qualified medical or eye care professional.
8. Use of Iris Images & Promotional Rights
By booking and attending a session, you give Iris Photography AU permission to use selected iris artwork for portfolio, website, social media, advertising, marketing, printed material, and promotional purposes, unless you tell us before or during your session that you do not want your image used.
We will not publish your name, contact details, or private personal information alongside your iris image without your permission.
If you do not want your iris artwork used for promotional purposes, please inform us before or during your session.
If you notify us after your session, we will make reasonable efforts to remove any unused or unpublished promotional content where reasonably possible. However, we cannot guarantee removal of content that has already been published, shared, printed, exported, archived, included in wider promotional material, or otherwise used before we received your request.
9. Photography, Filming & Behind-the-Scenes Content
By booking and attending a session with Iris Photography AU, you acknowledge that photos and/or videos may be captured during your session. This may include behind-the-scenes footage, client reactions, setup footage, session footage, and other related content.
This content may be used by Iris Photography AU for business purposes, including social media, website content, advertising, marketing, promotional material, training, internal business records, and portfolio use.
If you do not wish to be photographed or filmed, or do not want identifiable content of you used for promotional purposes, you must inform us before or during your session. We will make reasonable efforts to avoid capturing or using identifiable content of you.
If you notify us after your session, we will make reasonable efforts to remove any unpublished and unused identifiable content where reasonably possible. However, we cannot guarantee removal of content that has already been edited, exported, published, shared, printed, included in wider promotional material, or captured as part of group or behind-the-scenes footage.
For clients under 18, consent must be provided by a parent or legal guardian.
Choosing not to be photographed or filmed will not affect your session, final artwork, or customer experience.
10. Children, Minors & Group Consent
Clients under 18 must have consent from a parent or legal guardian.
If you are booking on behalf of a child, family, group, partner, or other person, you confirm that you have the authority to accept these Terms & Conditions on their behalf.
You are responsible for ensuring that everyone in your group is aware of these Terms & Conditions, including the use of flash, promotional image use, filming, privacy, payment, cancellation, and refund terms.
If a child or participant is unable or unwilling to safely complete the session, we may pause, stop, or reschedule the session at our discretion.
11. Copyright & Intellectual Property
All photographs, iris images, edits, designs, files, and final artworks remain the intellectual property of Iris Photography AU unless otherwise agreed in writing.
When you purchase a digital file or product, you are granted a personal-use license. This means you may use your purchased image for personal purposes, including printing, gifting, sharing with friends and family, and posting on personal social media.
You may not resell, commercially reproduce, edit, alter, claim as your own work, use for business branding, use in commercial advertising, or commercially distribute any image or artwork without written permission from Iris Photography AU.
Raw, unedited, layered, project, or working files are not included with any purchase unless agreed in writing. Final edited files are supplied at our discretion in the format we consider suitable for personal use, printing, and delivery.
12. Digital Files, Delivery & Turnaround Times
Digital files are supplied in the format and resolution stated at the time of purchase.
Any delivery or turnaround times provided are estimates only unless expressly confirmed in writing. We will make reasonable efforts to deliver digital files and products within the estimated timeframe, but delays may occur due to editing workload, supplier delays, courier delays, technical issues, illness, travel, peak demand, or other circumstances outside our reasonable control.
You are responsible for downloading, saving, and backing up your digital files once they have been delivered.
We may not store digital files permanently. While we may keep files for a period of time for customer support, reorders, portfolio use, business records, or operational reasons, we do not guarantee that files will remain available indefinitely.
13. Prints, Frames, Acrylics, Canvases & Product Variations
Prints, frames, acrylics, canvases, and other physical products may vary slightly in colour, brightness, contrast, size, cropping, finish, and appearance compared to what is seen on a phone, computer, or tablet screen.
This can happen due to screen brightness, display settings, print materials, lighting conditions, glass reflections, supplier processes, and natural differences between digital and printed media.
Where we use external suppliers, framers, printers, couriers, or fulfilment partners, we are not responsible for delays, courier handling issues, or supplier-related variations outside our reasonable control. However, we will do our best to help resolve genuine issues where possible.
If a physical product arrives damaged or faulty, you must contact us within 48 hours of delivery with clear photos of the packaging and product. We will review the issue and, where appropriate, arrange a replacement, repair, or other suitable solution.
We may not be able to assist with damage reported after this period, or damage caused by mishandling, incorrect hanging, moisture, heat, direct sunlight, accidents, incorrect storage, incorrect installation, or general wear and tear.
14. Refunds, Re-Edits & Re-Shoots
Due to the custom and artistic nature of our work, all sales are final for change of mind, personal preference, dissatisfaction with natural colour variation, editing style, artistic interpretation, or differences between screen and print appearance.
This does not limit any rights you may have under the Consumer Guarantees Act 1993 or any other applicable law.
If a technical issue occurs, such as corrupted files, equipment failure, or an error caused by us, we may offer a re-edit, replacement, re-shoot, store credit, partial refund, or full refund at our discretion, depending on the circumstances.
Refunds are not guaranteed once a session has been completed, digital files have been delivered, or custom products have been ordered, unless required by law.
Requests for re-edits must be reasonable and related to the purchased artwork. We may decline requests that are outside our artistic style, technically unsuitable, excessive, or inconsistent with the product originally purchased.
15. Data, Privacy & File Storage
We collect personal information only where reasonably necessary to manage bookings, process orders, deliver products, communicate with you, provide customer service, meet legal obligations, and operate our business.
This may include your name, contact details, booking details, order information, payment status, images, communication history, delivery details, and session notes.
We do not sell your personal information.
We may share relevant information with trusted service providers where required to process bookings, payments, editing, printing, framing, delivery, website hosting, file storage, customer communication, accounting, legal obligations, or business operations.
We may retain image files, order records, communication history, and booking information for as long as reasonably necessary for editing, delivery, customer support, reorders, tax, accounting, legal, dispute-resolution, and business record purposes.
If you request deletion of your personal information or image files, we will make reasonable efforts to remove them where legally, technically, and commercially possible. This may not apply to files already delivered, printed, published, archived, included in wider content, or required for legal, tax, accounting, dispute-resolution, or business record purposes.
16. Liability
To the maximum extent permitted by law, Iris Photography AU is not liable for indirect, incidental, special, or consequential loss, damage, expense, or inconvenience arising from your session, images, products, or use of our services.
Our total liability, where liability cannot be excluded, will not exceed the amount paid by you for the relevant session or product.
17. Indemnity & Release
You agree to release and hold harmless Iris Photography AU, its owners, contractors, employees, and representatives from claims arising from:
The use or misinterpretation of your iris images.
Any discomfort or sensitivity caused by the photography process where we were not informed of a relevant condition beforehand.
Any use of the images for non-artistic, medical, biometric, identification, commercial, or unauthorised purposes.
Any issue caused by information you failed to provide before or during the session.
Any error in customer-supplied names, dates, coordinates, quotes, spelling, or personalised details.
18. Force Majeure
We are not liable for delays, cancellations, or service failures caused by events outside our reasonable control. This may include weather, natural disasters, illness, injury, equipment failure, power outages, courier delays, supplier delays, venue issues, government restrictions, market changes, travel delays, or other unexpected circumstances.
Where possible, we will make reasonable efforts to reschedule, replace, or resolve the affected service.
19. Dispute Resolution & Governing Law
If a dispute arises, both parties agree to first attempt to resolve the matter through direct communication and informal negotiation.
If the dispute cannot be resolved, the parties may agree to mediation before taking further legal action.
These Terms & Conditions are governed by the laws of Australia.
20. Changes to These Terms
Iris Photography AU may update these Terms & Conditions from time to time. The latest version will be available on our website.
The Terms & Conditions that apply to your booking or purchase are the terms available at the time your booking or purchase is made, unless otherwise required by law.
21. Acknowledgement & Agreement
By booking a session, attending a session, purchasing a product, or engaging our services, you confirm that you have read, understood, and agreed to these Terms & Conditions.
If you are agreeing on behalf of a group, partner, family member, child, or minor, you confirm that you have the authority to accept these Terms & Conditions on their behalf.
